What are Section 125 Plans?

One type of group insurance benefits that may be offered by an employer are Section 125 Plans. These Section 125 Plans are also known as cafeteria plans, flexible benefit plans or mini-flex plans. The Internal Revenue Code Section 125 outlining these plans first appeared in the tax code in 1978, but didn't gain popularity until tax laws changed in 1986 and gave employees greater tax advantages.

The purpose of the code was to allow employers to have a separate written plan for their employees that provided them with an opportunity to receive certain fringe benefits on a pretax basis. All plans are strictly regulated by the IRS and must meet specific requirements and regulations that can and do change. The written plan must specifically describe all benefits and establish rules for eligibility and elections. Because of the stringent guidelines, many employers offering these plans have them administrated by an outside source.

How do Flexible Benefit Plans Work?

Each payroll through a deduction from their paycheck, the participant contributes money to a Spending Account. This money is not taxed. The participant is then reimbursed from this account by their employer (or outside Administrator) for those health care expenses not covered under a health insurance policy or by a health care provider.

The participant's expenses are reimbursed in full up to the maximum amount of their annual election at the time the claim is submitted. The expenses must be incurred during the plan year while they are covered by the plan. Any funds left in the Spending Account at the end of the plan year will be lost.

These plans run for a year at a time. At the beginning of the plan year, the participant chooses how much they are going to contribute - called the annual election. A participant can have two Spending Accounts; one for themselves (called the Health Care Account) and one for their dependents (called the Dependent Care Account). The Health Care Account and the Dependent Care Account are treated separately and so funds from one account cannot be transferred to the other account.

In deciding what the annual election should be, a participant should look at their health insurance deductibles and copayments, as well as uninsured medical, dental, vision care and hearing care expenses. The uninsured expenses covered must be "medically necessary" as determined by a doctor or healthcare service provider.

You may see some generalized expense categories listed when people talk about what expenses are covered. These may include things like:

> Non-reimbursed medical expenses resulting from charges due to hospital, physician, dental, orthodontia, vision, and prescription drug expenses incurred.

> Deductibles and copayments resulting from charges due to hospital, physician, dental, orthodontia, vision, and prescription drug expenses incurred.

> Rehabilitation services over a long-term period to include drug and alcohol addiction.

> Health care expenses that meet medical expense requirements for federal income tax purposes.

Why are Flexible Benefit Plans Good?

From the employer's point of view, you are offering your employees an added benefit and helping them to save money on their taxes.

From an employee's point of view, you save taxes and you pay for health care expenses not covered under a health insurance policy or by a health care provider with money that has been set aside for you through payroll deductions. Thus, when these expenses come due, you don't have to pay for them from your daily cash flow.

Without a 125 Plan, you have no pre-tax deductions for premiums, child/dependent care or other out-of-pocket medical expenses.

So say you made $26,000 a year. Without the pre-tax deductions allowed by a 125 Plan, you would be taxed on the full $26,000. At a Federal Income Tax Rate 15%, a State Income Tax Rate of 3% and a Social Security Tax of 7.65%, you would be taxed a total of $6,669.00 on your income of $26,000 if you didn't have a 125 Plan.

If you had a 125 Plan and paid $1,000 for premiums, $5,000 for child/dependent care and $500 for out-of-pocket medical expenses for a total of $6,500 you would be taxed on $19,500 instead of the full $26,000.

At the same tax rates mentioned above, you would be taxed a total of $5,002.00 if you did have a 125 Plan.

And don't forget without a 125 Plan that you would still have those premium, child/dependent care or other out-of-pocket medical expenses of $6,500 to pay.

So what does that all mean to your net take-home pay?

Without the 125 Plan:

$26,000 = $12,831

With the 125 Plan:

$26,000 = $14,498

By participating in a 125 Plan, you would bring home an extra $1,667.

program helps publishers put their books and information in a searchable mode.

The economics make sense for rental properties as well. A Study by the Institute of Business and Economic Research in April 2008 shows higher rent and occupancy rates for "green" office buildings throughout the U.S. Also of concern for property owners is the affect of indoor air quality on occupants' health. When I was a teenager we walked the banks of Utah's Jordan River and counted the birds for the Audubon Society during the Christmas Bird Count. Right after WW II, we recorded our maximum count. We saw 139 species of birds and many thousands of individuals.

Then construction of new housing moved in.

In just a few years the Christmas count for that area dropped from 139 species to 13 species. The river had considerable hunting pressure, but the majority of birds were not affected. Those species that were affected had habitat in which to hide when the bullets were flying.

It's fair to say that there was a time when females generally had limited career aspirations. They grew up, they got married, they had children and then they looked after them - that was just about it. Women knew it and men knew it; men had the careers, men were the 'breadwinners' and men made all the decisions. During WW1 but even more so during WW2, women were the indispensable powerhouses behind our war efforts. Women's voluntary work was largely replaced by conscription in 1941 when by act of parliament the government began to integrate them into a variety of previously male dominated roles. They took jobs in the manufacture of tanks, ships, aircraft and munitions working alongside men in difficult and challenging conditions. Many women became members of the 'Land Army' working on and managing our farms.

There is also much to be said about the wartime role women played in espionage in which pursuit many of them risked their lives and ultimately died for their country. Their intellectual contributions in places such as the wartime code breaking centre, Bletchley Park, are also the stuff of legend.

Little wonder then that as we emerged from the dark days of the first half of the 20thCentury women had a new voice and they weren't about to get shouted down. Unfortunately, it was to be several decades before any really meaningful changes took place.

Things didn't really start happening for women until the 1970's and 1980's. Yes, there were women in business and lots of them, but they were mostly secretaries and typists. Gradually however, women began to take more significant roles e.g. in 1977 Aer Lingus employed their first female pilot who co-incidentally retired in 2010 after 33 years of service. It took BA until 1987 before they employed their first female pilot and today they employ around 200. There are many female pilots in our own UK military as well as other militaries around the world such as Canada, where female F16 pilots operate daily in frontline roles.

One of the most notable post war changes for women was when Margaret Thatcher, a grocer's daughter from Grantham, became the leader of a political party in 1975; not just any old party either but the Conservative Party, the party of the establishment!

At around the same time in 1976, Anita Roddick started 'The Body Shop' which subsequently grew at a meteoric rate. Their shares were soon listed on the LSE and quickly earned the nickname as 'the shares that defy gravity'. The 'Body Shop' chain was sold for �650m to L'Oreal in 2006 just prior to her death.

In the eighties, women were well and truly on their way in the modern world and in the years that followed it became commonplace to see them in senior and middle management roles as well as CEO's of household name companies. Women are now also firmly established in the formerly closed shops of the legal and medical professions, many of them having achieved 'eminent' status. Oh! and don't forget female Astronauts.

More recently, women have infiltrated perhaps the last bastion of male dominance i.e. 'the trades'. In the last 5 years, more and more women have begun electrician courses and plumbing training. It is no longer surprising to see female trades people and if men aren't careful they could eventually find themselves in the minority. Women tend to have more attention to detail, are tidier and more polite: qualities that are invaluable when dealing with ones customers!

There is also an enormous untapped market for female tradespeople. These days' females routinely own their own properties and given the choice, it is certain that many of them would prefer to be visited in their homes by a female tradesperson.

There is no telling which trades and professions will eventually be totally dominated by women, I just know that some definitely will be. I also know that I gave up worrying about it when the 'men only' bar at my golf club was finally abolished; I have to say that I liked it then and I like it now; thankfully, some things never change.

The Court found that flight lessons did not maintain or improve skills as a commercial realtor.

Direct evidence is required that correlates deductible expenditures with a business or investment activity. Taxpayers with claims for extraordinary tax-deductible expenses are wise to make preparation of their tax returns into jobs for enrolled agents. This decision results in accuracy that averts improper deductions. Two taxpayers who failed to choose that path were caught and charged for back taxes by the Tax Court last year.

Well, that may be true but your presence in the room or down the hall is not enough.

Frustrated family members concerned about the level of care their loved one is receiving call often. Most of the time, their complaints cannot and should not be addressed by filing a lawsuit - so we provide more general advice. That advice is as follows:

Be Organized:

Keep a diary or a log of every visit to the nursing home or assisted living facility and include the following information:


  • Date / time of visit.

  • Location - where your loved one was upon arrival.

  • Complaints - stained clothes, sheets, food problems, no water? Write the complaints down.

  • Notify staff - make a written and verbal complaint to the charge nurse. Write down her name, and what she said would be done about the problem.

  • Follow up - next time you are there and ask the nurse what has been done. Ask to see the chart where the corrected action should have been documented.


Document Your Complaints:

If the problem continues take photographs; send a letter to the nursing home administrator requesting a conference. Ask that staff receive further training. Ask to see the facility's policies and procedures (you have this right under the Virginia Administrative Code) and compare what the staff is doing with what is required by the facility's policies and procedures.

Complain to State/Local Authorities:

If the problems get worse, or a single accident causes harm, call your local Department of Social Services (each County has one) and ask to speak to Adult Protective Services. File a complaint. You may call the Virginia Department of Health (1-800-955-1919) and file a complaint with them as well.

How to Work with Attending Physicians:

Many attending physicians also serve as Medical Directors to the facility. They are only obligated to review a resident's chart and or examine them, pursuant to Medicare requirements, and when a change in condition occurs. Ask to speak to the attending physician after each visit to determine whether there has been a change in condition. If it is a routine visit, contact the physician to find out what was examined. If medications are changed, ask why? Be curious, and write down the answers you receive. We have discovered in our cases where some nurses actually will draft the physician's orders and then call the physician after the fact, just to get their "ok".

What to do if a Fall Occurs:

If a fall occurs immediately go the facility. Ask for the name of individual who found your loved one. Where was the fall? What was he wearing? Was there medical equipment involved? Write all of this down. Who examined your family member to assess their status after the fall? Who determined that no injury occurred? Did a roommate witness the fall?

Follow up with the charge nurse - ask what is being done to prevent another fall. Ask to attend the Fall Committee's next conference when your family member is being discussed.

Also, consider the context of the fall - what time of day? Where were they going? Had they asked for help? Do they have the ability to ask for help? Is your family member taking any new medications which may cause dizziness?

What if Your Resident Stops Eating:

We hear staff say all the time - "we tried to get her to eat, but she refused." Is that true? What is the facility policy? I am certain the policy doesn't say, "if resident refuses to eat discontinue attempts." It likely requires staff to provide an alternative or supplement until the resident gets needed calories. Malnutrition can lead to the development of decubitus ulcers and prevents existing decubitus ulcers from healing.

Review the chart. Can your loved one see to eat? Can he or she feed themself? What about the food - will he eat what you bring? If so - tell the nurse and ask them to chart it. Patient refusal is a big excuse given by facilities when problems occur.

Discuss supplements, intravenous nutrition, energy bars - there are ways to get needed calories in. Is the physician aware? Make him aware.
